About the Author
Frank Sloan has been the J. Alexander McMahon Professor of Health Policy and Management and Professor of Economics at Duke University since 1993, where he holds faculty appointments in the Department of Economics, the School of Public Policy, the Fuqua School of Business, and the School of Nursing. Before joining the faculty at Duke, he was a research economist at the Rand Corporation and served on the faculties of the University of Florida and Vanderbilt University. His current research interests include alcohol use and smoking prevention, long-term care, medical malpractice, and cost-effectiveness analyses of medical technologies. Professor Sloan also has a long-standing interest in hospitals, health care financing, and health manpower. He has served on several national advisory public and private groups, including the Physician Payment Review Commission. He has been a member of the Institute of Medicine of the National Academy of Sciences since 1982, recently chairing IOM committees on vaccine financing and cancer in low- and middle-income countries. He recently received a Merit Award from the National Institutes of Health and an Investigator Award from the Robert Wood Johnson Foundation. Professor Sloan's most recent books include The Smoking Puzzle: Information, Risk Perceptions, and Choice (2003) with Drs V. Kerry Smith and Donald H. Taylor, Jr., and The Price of Smoking with Drs Jan Ostermann, Gabriel Picone, Christopher Conover, and Donald H. Taylor, Jr. (2004). Professor Sloan received his Ph.D. in economics from Harvard University in 1969.

Chee-Ruey Hsieh is a Research Fellow in the Institute of Economics at Academia Sinica, Taipei, Taiwan. He received his Ph.D. in economics from Vanderbilt University in 1990. Dr Hsieh has a long-standing interest in health economics and health policy. He is the coeditor of two other books: The Economic Analysis of Substance Use and Abuse, and The Economics of Health Care in Asia-Pacific Countries.

A Very Good Primer

Anyone who has taken a seminar from me knows I attack "Intellectual Property Rights" (IPR) as a bad idea for small business. I draw on what I learned from the highly successful people I worked for long ago, and what has proven true being self-employed myself these last 25 years. As a practical matter far from harming my business, eschewing IPR gives me a competitive advantage when competing on design as opposed to monopoly or price.

I lay out this view in the morning session, and then follow up in the afternoon, while directly addressing contracting designers, with the views of a patent attorney by the name of Stephan Kinsella out of Houston. It was a delight years ago to read his critique from a patent attorney's point of view, with which I concurred. He is more radical (and right) than another lawyer who is somewhat anti-IPR, Lawrence Lessig, the Stanford Law professor. I've developed my arguments over time to the point I was invited to spend an hour making my argument to 17 patent attorneys at a leading IP firm in Seattle last Fall. The IPR lawyers know change is coming, and are working to correct the abuses.

With business and law advancing arguments against IPR, that left academia to round out the condemnation. Washington University professors Michelle Boldrin and David Levine do just that in their book AGAINST INTELLECTUAL MONOPOLY. These are not some flakes being contrarian to get attention, they are regime intellectuals and their book is endorsed by three Nobel Laureates and Lawrence Lessig.

Business in USA is split between the Hamiltonian and Jeffersonian ethics, one loving fascism and the other loving freedom. Obviously with war and economic depression and shortages the Hamiltonians have had the upper hand, so it is very welcome to see a central tool of the bad guys in the USA economy, IPR, being taken apart both by law and academia.

Lawyers practice law and academics practice theory, neither of which seem to be very well informed about how business happens. In some ways their arguments are far more important, since they influence the thinking of so many people. Although it is unstated, AGAINST INTELLECTUAL MONOPOLY proceeds from the theoretical basis laid down by R H Coase as he has laid out in THE FIRM, THE MARKET AND THE LAW. At some point I will review that enormously influential book, but suffice it to say Coase is a Hamiltonian. Essentially, their guiding light is "does policy result in aggregate in a net increase in prosperity.?" By their analysis, the answer is no, IPR is a net deficit. For this conclusion, the book is most welcome, and should be read for the examples that contradict the "pro-IPR" arguments. Jeff Tucker at the Mises Institute has read the book and wrote a series of essays that might be a companion piece that you should read alongside the book.

AGAINST INTELLECTUAL MONOPOLY carefully takes apart the IPR regime as it is, but says nothing about what might be if we were to rid ourselves of it completely. You'll be glad when you put the book down that you've been disabused of the notion that IPR is a good thing, especially the nonsense that we'd have no new medicines without patent monopoly to recover the up front costs. But what should we do? Coase was flexible on policies, because the acid test for his followers is the vague "net increase in wealth." their solution is wishy washy.

That leaves the task of someone writing a book that rejects IPR from a free market point of view, laying out what we would have absent intellectual property rights, and give any startup competitor a road map for crushing those who want to compete by monopoly, doing good while doing well.

A very clear set of arguments for the non-economist.

Before continuing, you should know that I also read the free copy available online, not the print book.

The book is a simple and clear set of reasoned arguments against the existence of intellectual monopoly. Boldrin and Levine are careful to distinguish between intellectual property rights and intellectual monopoly: intellectual property is argued to be just as important as other property rights, while they eventually equate intellectual property to something close to public theft.

No difficult math or statistics are employed, so the average reader will be able to understand the arguments and agree or disagree. Each chapter also includes references to statistical and mathematical treatments of the subjects, although I wish they'd included brief outlines of these in an appendix.

The ideas themselves are impressively simple. Arguments in favor of intellectual monopoly can be made to seem very obvious. Arguments against intellectual monopoly can be a little complicated. It's easy to say that patents and copyrights are necessary to pay back authors and inventors for their risks and creativity. But how much should they be payed back? And does it occur without government intervention in the forms of patents and copyrights? Does piracy actually put the legitimate creators and inventors out of business?

One striking example from the book was the Linux company Red Hat, which distributes the open-source Linux platform and provides support. Its pirating competitors sell the same thing for cheaper (and indeed, the whole thing is available for free!) and yet Red Hat has grown and its competitors have shrunken or disappeared altogether. Boldrin and Levine point out that while something may be free, people are still willing to pay for other peoples' knowledge. There is value in knowledge, and consumers don't always have the time to educate themselves. Those with a background in economics will remind themselves immediately that there is no such thing as a free lunch: even pirated material has an opportunity cost of time, or might require a certain level of knowledge. Another interesting example was the pornography industry. Here is an industry that has always been a constant target of piracy, yet it continues to grow!

Boldrin and Levine have managed to simplify the arguments into clean examples and easy statistics. Unfortunately, I find that when the statistics do not go in their favor they are more likely to wave away the outliers than attempt to explain them, a choice I find leaves their argument looking weaker than it might otherwise be.

Overall, the book is a pretty quick read that will inform you of several arguments in the anti-monopoly position. The writing is clear and direct. Boldrin and Levine also have an off-beat sense of humor, which at times made me smile but mostly made me grimace.

Recommended to anybody interested in this current debate, regardless of the side of the debate on which you may fall.

For mathematical physicists

This book begins by recounting what the student would learn in a physics class on Newtonian mechanics and planetary motion and then goes into specifics of the three-body problem. While unsolvable in closed form, the solution, in general, involves chaotic dynamics. Nonetheless, there is much to be had in studying various forms of the problem under differing conditions. This book goes a long way to exploring these forms of how different scenarios can be approached.

The authors begin with a presentation of Newtonian mechanics and uses these to solve the two body problem. The authors use physics to motivate the mathematics and derive the equations of motion---here, and throughout the book. Thus, the discussions are complete and present the ideas from the view of mathematical physics.

After discussion of the two-body problem we are introduced to Hamiltonian mechanics and some restricted three-body problems such as satellite orbits, and scatterings of bodies from a binary orbit. Other topics include escapes, three body scattering, and capture. The final topics deal with perturbations and various astrophysical problems such as black holes and the evolution of comet orbits.

Throughout the book the authors present diagrams to illustrate their points but these diagrams are limited in their utility. The authors could have presented more illustrative diagrams and figures to better qualify the text.

When I started reading I thought the book would discuss chaos and its relationship to the three body problem. After all, that's the first thought that comes to mind today. There is mention of this phenomena but very little, and no attention given to simulating orbits of three body motion. For me, this was a disappointment.

Finally, the spirit of the book is mathematical physics and consequently, the authors often leave much work to the reader to sort through the mathematics. I often found, for example, that I had to review earlier parts of the text and seek equations---always present somewhere in the text but not explicitly noted nor cited---to follow the derivations and fill-in many of the steps.

In short, this is a good text on the mathematical physics of the problem for the experience practitioner. Everyone else, I'm afraid, will find it a challenge to read and follow the mathematics.

I do not agree with the previous reviewer(s) that the book is written for mathematical physicists. In my view it completely lacks any modern developments (geometric mechanics). The book starts off with the two-body problem from a simplistic, Newtonian point of view. After that, the Lagrangian formulation and Hamiltonian formulation are developed, but only in an undergraduate way. It's understandable if you have already seen it before, but don't be fooled: the text is not intended for people who do not know what it's about. Then, finally, the three-body problem is described. Mostly done from Valtonen's own research and that of his buddies in Finland. Some research that is outlined is done so poorly for two main reasons: the original papers aren't any more clear than what they present in the book, and it's highly guess-work. A lot of details come from "fitting nice functions" through numerical data (generated from simulations), and then doing some "interesting" physics.

In my opinion, the book lacks any direction. It's not intended for undergraduates, because the text does not contain enough information for them to grasp it, although their point of view has been kept in mind in writing it, but it's not for graduates either, because Poincaré's work is about as modern as it gets, from a mathematical point of view. Chaos is described very poorly, and most comes from doing numerical computations, although great mathematical work could have been shown. I think this book should be avoided at any cost. It's probably one of very few books on the topic, but it's not worth buying.

About the Author
Ezio Biglieri is an Adjunct Professor at the Universitat Pompeu Fabra, Barcelona, Spain, University of California, Los Angeles and King Saud University, Riyadh, KSA.

Andrea Goldsmith received her Ph.D. from the University of California, Berkeley, and is an Associate Professor of Electrical Engineering at Stanford University. Prior to this she was an Assistant Professor at the California Institute of Technology. She has also held positions in industry at Maxim Technologies and AT&T Bell Laboratories. She is a Fellow of the IEEE, has received numerous awards and honors and is the author of over 100 technical papers in the field of wireless communications.

Arogyaswami Paulraj received his PhD from the Indian Institute of Technology and is a Professor of Electrical Engineering at Stanford University. He is the author of over 250 research papers and holds eight patents. He has held several positions in industry, including Chief Technology Officer of Iospan Wireless Inc, and he is a Fellow of the IEEE and a member of the Indian National Academy of Engineering. He is also the recipient of the 2014 Marconi Prize.

I don't recommend this book for people who want to learn MIMO. If you need a reference to equations and such, it is fine, but there is no real explanation of any concepts in any level of detail.
